Wingstead — A home for their story

These Terms govern your use of Wingstead, available at wingstead.com ("the Service"), operated by Stevan Stevanovic, Smederevo, Serbia ("we", "us"). By using Wingstead you agree to these Terms. If you do not agree, please do not use the Service.

1. What Wingstead is

Wingstead lets you create an online memorial for a person who has passed away: a page gathering their biography, photographs, and the memories that family and friends choose to share. Memorials can be private (link-only) or public, at the creator's choice.

2. Your account

  • You must be at least 16 years old to create an account.
  • You are responsible for your account credentials and for activity under your account.
  • Provide accurate information and keep your email address current — it is how we reach you about your memorials.

3. Your content and your responsibilities

"Content" means everything you upload or write on Wingstead: photographs, biography text, tributes, audio, video.

  • You keep ownership of your content. You grant us only the license we need to operate the Service: to host, store, display, and technically process (e.g. resize) your content in order to show the memorial to the people you choose.
  • You must have the right to share what you upload. This includes photographs (you took them, own them, or have permission) and information about the person remembered and any living people shown.
  • You are the right person to create the memorial. By creating a memorial, you confirm you are a family member, close friend, or otherwise have a legitimate connection to the person remembered. Creating memorials of strangers, public figures you have no connection to, or living people is not permitted.
  • Contributors leaving tributes make the same promises about what they submit.

4. What is not allowed

We will remove content and may close accounts involved in:

  • Memorials created to mock, harass, defame, or harm — including memorials of living people, and "memorials" targeting anyone as a joke or attack.
  • Content that is unlawful, hateful, pornographic, or that exploits minors in any way.
  • Uploading content you have no right to share, including copyrighted photographs used without permission.
  • Impersonation, spam, scraping, attempts to breach security, or any use that interferes with the Service or other users.

5. Family disputes and removal

Memorials sit inside real families, and families sometimes disagree. Our approach:

  • The memorial creator controls the memorial and its tributes and may edit or delete them.
  • Close family members of the person remembered may object to a memorial or specific content by contacting hello@wingstead.com. We review such requests promptly and in good faith. Where a close family member objects and the creator cannot demonstrate a stronger claim, we may edit visibility settings or remove the memorial. Our guiding principle: a memorial exists to comfort, and we will not host one that a person's immediate family credibly opposes.
  • We are not a court and cannot resolve family conflicts; our decisions concern only what is hosted on Wingstead.

6. Copyright complaints

If you believe content on Wingstead infringes your copyright, email hello@wingstead.com with: the memorial link, identification of the work, your contact details, and a statement that you own the rights or act for the owner. We will remove or disable access to infringing content and may terminate repeat infringers' accounts.

7. Free service and paid features

  • Core memorial creation is currently free. We may introduce optional paid upgrades (for example, one-time "lifetime" upgrades that unlock additional features for a memorial).
  • Prices will be shown before any purchase. Payments are processed by a third-party payment processor. One-time upgrade purchases are refundable within 14 days of purchase if you change your mind — email hello@wingstead.com and we will process the refund.
  • If we ever discontinue a paid feature you purchased, we will provide a reasonable remedy (such as a comparable feature, export of your memorial, or a refund).

8. Permanence, and its honest limits

We built Wingstead for memorials to last, and we intend to preserve them indefinitely, including if the creator's account goes quiet. At the same time, we are honest about what a small service can promise: we cannot guarantee the Service will exist forever. If Wingstead were ever to shut down, we commit to giving account holders at least 90 days' notice and a way to export their memorial content before anything is removed.

Please keep your own copies of irreplaceable photographs. Wingstead is a home for them, not your only archive.

9. Service changes and availability

We may add, change, or remove features, and the Service may occasionally be unavailable (maintenance, outages, circumstances beyond our control). We provide the Service "as is" and "as available", without warranties of uninterrupted or error-free operation.

10. Termination

  • You may stop using Wingstead and delete your account at any time.
  • We may suspend or terminate accounts that violate these Terms. Where reasonable, we will warn you first and give you a chance to export your content, except in cases of serious abuse.

11. Liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, or consequential damages, loss of data, or loss of profits arising from your use of the Service; our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or 50 USD. Nothing in these Terms limits liability that cannot be limited by law, including for willful misconduct.

You agree to indemnify us against claims arising from content you upload in breach of section 3 (for example, photographs you had no right to share).

12. Governing law

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected.

13. Changes to these Terms

We may update these Terms. For meaningful changes we will update the date above and notify account holders by email. Continued use after changes take effect means you accept the updated Terms.
